Frequently Asked Questions

  • Our team is led by Michigan civil rights attorneys Carl Edwards and Alice Jennings of Edward & Jennings PC, and includes attorneys from Lieff Cabraser Heimann and Bernstein, and Kershaw Talley Barlow.

In addition to our legal team, we're connected with Benton Harbor leaders like Rev. Edward Pinkney to better connect with and support community residents as we seek to hold government officials accountable for this water crisis.

  • A federal class action lawsuit is pending in front of Judge Janet T. Neff in the United States District Court for the Western District of Michigan. The case is in its beginning stages, and community members are still able to join the lawsuit.

  • Our goal is to seek justice on behalf of this community. Part of that includes seeking monetary damages for the harm caused to individuals, especially children. It is also critical that people subjected to lead from the water can be tested for possible harm going forward. Ultimately, people in Benton Harbor have the right to clean, safe water, and this lawsuit will help restore that.

  • Exposure to lead and other bacteria in the water can lead to damaging health effects, including high blood pressure, anemia, hypertension, heart disease, kidney impairment, hearing loss, immune system dysfunction, and toxicity to reproductive organs. In children, this damage can be particularly devastating, with lead exposure shown to lead to severe mental, cognitive, and behavioral developmental delays.

  • We highly recommend if you are feeling ill to seek medical treatment immediately.
